Terms of Service

1. Who we are & acceptance

These Terms of Service ("Terms") form a binding agreement between you ("Customer", "you") and ConsentSol, trading as "ConsentHub" ("ConsentSol", "ConsentHub", "we", "us"), the provider of the ConsentHub service available at consentsol.com (the "Service").

By creating an account, clicking "I agree", installing the ConsentHub script, or otherwise using the Service, you agree to be bound by these Terms. If you are entering into these Terms on behalf of an organisation, you represent that you have authority to bind that organisation.

2. What ConsentHub is

ConsentHub is a Consent Management Platform (CMP) and DSAR dashboard — software infrastructure that helps businesses collect, log, and manage end-user consent and data-subject requests. ConsentHub is not a "Consent Manager" as that term is defined under the Digital Personal Data Protection Rules; we do not act as a registered intermediary between Data Principals and Data Fiduciaries.

3. No legal advice

ConsentHub is a software infrastructure platform designed to help businesses manage consent workflows. ConsentHub does not provide legal advice. Compliance with privacy regulations (GDPR, CCPA, DPDP) ultimately depends on the customer's implementation, privacy policies, and business practices. Templates, generators, and checklists provided by ConsentHub are illustrative starting points only and should be reviewed by qualified counsel before you rely on them.

5. Acceptable use

You will not (a) use ConsentHub to unlawfully process personal data or to defeat or circumvent consent requirements; (b) interfere with, probe, scrape, or attempt to gain unauthorised access to the Service; (c) upload malware or infringe third-party intellectual-property rights; or (d) resell or sublicense the Service without our written consent.

6. Merchant of Record — Paddle

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle.com Market Ltd is responsible for billing, payment processing, invoicing, tax collection and remittance (including India GST, EU/UK VAT, US sales tax), currency conversion, and transaction-level buyer support.

Your purchase is subject to Paddle's Checkout Buyer Terms and Refund Policy, in addition to these Terms and our Refund Policy.

7. Fees, plans, renewals & taxes

Free-tier usage limits, paid plan features, and pricing are described on our pricing page. Paid plans are sold as monthly or annual subscriptions and automatically renew at the end of each billing period at the then-current rate until cancelled. You may cancel at any time from your Settings page or via the Paddle customer portal; cancellation stops future renewals and access continues until the end of the paid period. Fees are exclusive of taxes; applicable GST/VAT/sales tax is calculated and charged by Paddle. Overage above your plan may result in throttled logging or upgrade prompts.

9. Intellectual property

ConsentSol retains all right, title, and interest in and to the Service, including all software, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your plan. No reverse engineering, no redistribution, no circumvention of technical limits.

10. Data processing

When ConsentHub processes personal data on your behalf (for example, hashed IPs, consent events, and DSAR tickets), we act as your Data Processor. Our Data Processing Agreement and Privacy Notice form part of these Terms.

11. Warranty disclaimer

The service is provided "as is" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. ConsentHub does not warrant that use of the service will result in regulatory compliance.

12. Limitation of liability

In no event shall ConsentHub's total aggregate liability arising out of or related to this agreement exceed the total amount paid by the Customer hereunder in the twelve (12) months preceding the incident. ConsentHub will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data, even if advised of the possibility of such damages. For free-tier customers, aggregate liability is capped at INR 1,000.

13. Indemnity

You will defend and indemnify ConsentHub against claims arising from your content, your privacy notices, your data practices, or your violation of law.

14. Suspension & termination

We may suspend or terminate your access for (a) material breach of these Terms not cured within 30 days of notice, (b) non-payment, (c) suspected fraud or security risk, or (d) repeated or serious violations of the acceptable-use policy. Either party may terminate for convenience at the end of the current billing period. On termination, your data may be deleted after a reasonable retention window.

15. Governing law

These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of courts in Bengaluru, unless otherwise required by mandatory local law of the customer.
